When Multiple Policies Cover Loss, Targeted Insurer May Have Claim for Contribution from Nontargeted Insurers

Under the Court’s 2002 decision in Goodyear Tire & Rubber Co. v. Aetna Casualty & Surety Co., when a policyholder incurs loss or damage over an extended time period during which it was covered by multiple insurance policies issued by different insurers, and the policyholder files a claim targeting only one of those insurers, the targeted insurer may file a claim for contribution against a nontargeted insurer with applicable insurance policies.
